( I ) In the judgment, Hon’ble CAT Madras Bench in OA 773/2010 dated 21st June 2011 (mentioned in Dte’. New Delhi Letter F.No. 2-19/2011-PAP dtd 10-1-2013) , has referred the Hon’ble CAT Hyderabad Bench of the Tribunal order dated 03.11.2008 in OA No. 135 of 2006, where the Pay of the applicant , who was drawn Spl.Pay continuously for three (3) years prior to 22.04.1998, was allowed to fix the ‘pay’ by taking the ‘Spl. Pay’ termed as ‘Spl. Allow.’ as part of basic pay on financial up gradation under TBOP in the year 2004 i.e. obviously after 22.04.1998.
(II) The CPIO / ADG (Estt), Department of Posts, Dak Bhawan , New Delhi -110 001 through its letter No.5-1 (20) / 2013-PAP dtd nil December, 2014 has supplied copy of the Dte’ New Delhi Letter F.No. 2-19/2011-PAP dtd 10-1-2013 “as documents” against the query No. (1) under RTI Act-2005 ( placed by Tamal Ghosh of Sheoraphuli, Hooghly-712223) , i.e Dte’ New Delhi Letter F.No. 2-19/2011-PAP dtd 10-1-2013 may be treated as “supporting ruling / order of Dte’ regarding fixation of pay on promotion / financial up gradation after 22.04.1998 in r/o ‘PO & RMS Accountants’ in Postal Dept. Drawn spl. Pay Rs.90/- for more than 3 years continuously prior to 22.04.1998 and spl. Pay / spl. Allowance drawn @ Rs.180/- at the time of promotion”.
