Railways Propose to Cancel Some Trains during Fog Period

The Ministry of Railways has approved the following full/partial cancellation/diversion of trains during fog. There will be no booking for these trains during likely fog period from 1^st January 2013, which ever is earlier, to 17^th February 2013. Hover, the Ministry of Railways has directed Zonal Railways to keep a close watch on the field situation and in case there is no fog, booking for the trains, which are proposed to be cancelled, will be started with a three day notice with a condition that the train may be cancelled in case there is fog. The cancellation etc. of trains is being announced in advance so that travellers can plan their alternative journeys accordingly and are put to minimum inconvenience.

Dear Comrades,

            As decided by the Federal Secretariat of NFPE, this year’s NFPE Trade Union Study Camps are being organized on REGIONAL BASIS. “South Zone Study Camp “will be conducted at CHENNAI on 13^th and 14^th October, 2012.(13.10.2012 & 14.10.2012 Saturday & Sunday). Exact venue will be informed shortly. The Camp will commence at 10A.M. on 13.10.2012 and continue upto 5 P.M. on 14.10.2012 Participation of delegates from each Circle Union should be as per the quota shown below:

Quota in promotions: Attorney General cautions Government against proposed amendments

New Delhi: Despite an all-party consensus giving the government a go ahead to bring in a constitutional amendment for reservations in promotions, there are fresh hurdles.

Attorney General GE Vahanavati has cautioned the government on this proposal saying it could be easily challenged and may not stand in a court of law.

This he says, because the proposed amendments may be vulnerable to challenge on the ground that the basic fundamentals of equality and the structure of the constitution are violated.

The Supreme Court has held that three aspects needs to be looked into for reservations in promotions. That being backwardness, inadequacy of representation and overall administrative efficiency. It went on to say that only if these criteria are met then promotions given to people from the Scheduled Castes and Scheduled Tribes would be valid.

The country's top law officer has advised the government to bring in validating clauses to ensure that these aspects are looked into before bringing in the amendment.

The Attorney General also says the observations of the Supreme Court not only relate to the basic structure of the Constitution but also the fundamentals of equality.  Any amendments to those aspects are likely to be challenged and it is difficult to predict what the court would hold. 

He goes on to say if court takes a positive or wider view ( and not a restricted view ) of equality and upholds the contention that there can be no equality if a vast section of the people are denied an opportunity for advancement then the amendment could be sustained.

The Congress Party and the government has said they would bring a constitutional amendment which is legally sustainable.

Most political parties have given their concurrence and the Samajwadi Party even wanted this reservation in promotions to be extended to backward classes and minorities.

Cabinet clears reservation in promotions for SC/STs; Mulayam's party opposed

New Delhi: The Cabinet has cleared a proposal to amend the Constitution to allow reservation in promotions for Scheduled Castes and Scheduled Tribes in public services. The proposal will now be sent to a parliamentary committee for review, before being put to a vote. The amendments will enable state governments to provide reservation in jobs.

Amending the Constitution became necessary after the Supreme Court struck down in April this year, a decision made by Mayawati when she was Chief Minister of Uttar Pradesh, to provide reservation for SC/STs in promotion to higher posts in government departments

Mulayam Singh Yadav's Samajwadi Party, which rules UP now, has vowed to oppose the bill, which the government hopes to introduce in Parliament before the current session ends this week. At an all-party meeting on the issue in August, the SP stood out in its opposition; all other political formations supported quota in reservations. Mulayam Singh Yadav, who provides outside support to the UPA government and has bailed it out of sticky positions many times, sees this move as ppolitically damaging to his other backward caste (OBC) vote. The SP wants all quota benefits to be extended to OBCs. "This stand of the cabinet is wrong. The Samajwadi Party is against this and we will continue to protest," senior SP leader Ram Gopal Yadav said today. (Poll: Do you support quotas for promotion in govt jobs?)

 But Mayawati, who heads the Bahujan Samaj Party, is making focused efforts to get political parties to cooperate and allow a discussion and vote on the bill. She has met BJP leaders Sushma Swaraj and Arun Jaitley to seek their support. She said today, "We want to request for a voting on the bill in this session and request NDA to help us in this. We want UPA also to appeal to NDA to help us pass this bill."

To be passed this bill will need a two-thirds majority in Parliament as it seeks to amend the Constitution. Cobbling that together seems a tough task as Parliament has not been functioning because of daily disruptions by the BJP, which is demanding the PM's resignation in connection with a coal scandal. The bill might well be pushed to the Winter Session.
 
When it quashed the Mayawati decision, the Supreme Court had questioned this criterion for promotion, saying the government needed to quantify that Dalits and backwards were insufficiently represented in the public services and therefore needed this quota. The court had said that three aspects needed to be looked into for reservations in promotions: backwardness, representation and overall administrative efficiency.

Attorney General GE Vahanvati has warned the government that any law on the reservations issue should be framed with extreme caution because it is likely to be legally challenged.

The Prime Minister has said that a legally sustainable solution will be found. To legally combat any challenge, the proposed bill seeks to amend four key articles of the Constitution.
However, it might still run into rough weather in the courts. Constitutional expert PP Rao said that if the government brings in amendment without "curing the defects" pointed out by SC then it may not stand legal scrutiny.

Measures Against Hacking

As per the information tracked and made available to Indian Computer Emergency Response Team (CERT-In) 201, 303, 308 and 273 government websites were hacked during the year 2009, 2010, 2011 and 2012 (till July) respectively.

Based on the threat assessment, CERT-In regularly issues alerts for internet users and operators on vulnerabilities. 5 alerts were issued during May – June, 2012 to prominent organizations in the Government and Private sector about targeting websites for carrying out cyber attacks by the hacker groups. CERT-In also issued advisory providing countermeasures to safeguard the websites and network infrastructure against such attacks. All the organizations were also advised to report such incidents to CERT-In along with network logs and relevant data for analysis. Such alerts and advisories are available on CERT-In’s website: (www.cert-in.org.in).

National Informatics Centre (NIC), hosting majority of government websites has deployed state-of-the-art technology solutions including Firewalls and Intrusion Prevention Systems. NIC performs periodic security audits of their network infrastructure followed by subsequent hardenings, besides round-the-clock monitoring of security events for taking remedial measures against cyber attacks.

CERT-In is keeping a close watch on the Distributed Denial of Service (DDoS) attacks through active eco-operation with the Internet Service Providers (ISPs) in India. Security awareness training programmes on ‘Security measures against DDoS attacks’ are also organised by CERT-In for the network administrators in the government and private sector organisations.

The Minister of State for Communications and Information Technology Sh Sachin Pilot gave this information in the Rajya Sabha recently.

Emission of Carbondioxide

As per information available, the countries which are the largest contributor to Green House Gas (GHG) emissions in percentage terms are: China - 19.5%, USA - 19.2% India - 5.3%, Russia - 5.1%, Japan - 3.6% and Germany - 2.6%.
As India`s Gross Domestic Product grows, its emissions will increase in absolute terms but the growth rate of emissions will moderate as reflected in declining emissions intensity of Gross Domestic Product. As per Indian Network for Climate Change Assessment Report released in May 2010, the country`s GHG emissions have increased from 1228 million tones Carbondioxide (mtCO2) equivalent in 1994 to 1727 mtCO2 equivalent in 2007.

India does not have legally binding reduction commitments under Kyoto Protocol. However, Government of India is taking steps voluntarily to reduce GHG emissions. The Government has released the National Action Plan on Climate Change (NAPCC) in June 30, 2008 which outlines India’s strategy to meet the challenge of Climate Change. Two of the eight National Missions i.e. National Solar Mission and National Mission on Enhanced Energy Efficiency relate to mitigation of emissions and include ambitious programmes aimed at generating solar power and conserving energy. Energy Efficiency mission envisages setting norms for achieving energy efficiency under perform, achieve and Trade Scheme. Further, public and private sector entities participate in the Clean Development Mechanism (CDM) of the Kyoto Protocol which helps in reducing emissions. These initiatives have the effect of reducing carbon emissions.

Further, Planning Commission has constituted a 25 Member Expert Group to prepare a low carbon sustainable growth strategy. The Expert Panel has prepared an interim report in May 2011 covering options to reduce GHG emission intensity in critical sectors of the Indian economy such as Power, Transport, Building, Industry and Forestry.
