CHQ writes to DDG(Estt) for enhancement of HRA
MNREGA beneficiaries to be compensated for delay in payment
NEW DELHI: The Rural Development Ministry has amended a key schedule of the ambitious MNREGA under which they will be guaranteed compensation in case oftechnical delays in payment of wages.
Regretting that delays have been reported from all states despite clear provisions, the Ministry brought out the amendments stipulating that "if the payment is not made within 15 days of closure of the Muster Roll, compensation at the rate of 25 to 50 per cent of the wage (depending on the number of days) will be given."
In a letter to all the chief ministers, Rural Development Minister Jairam Rameshsaid,:"the MIS (Management Information System) and field reports suggest serious delays." and according to MIS, wages amounting Rs 2,700 crore (25 per cent of the total wage payments across the country) have been delayed over 15 days."
The new amendments make it clear that states should fix responsibility of functionaries and time limit for each stage of the wage payment process.
"In case of delay at any step, the compensation amount will be recovered from the responsible functionary/agency," it says.
Ramesh said that the entire process will be closely monitored through MIS. The MIS will also automatically generate the compensation due in case of delays at any stage.
"Streamlining wage payments is the most fundamental and vital step to guaranteeing MNREGA's entitlements to its beneficiaries. I hope you will take immediate measures to implement the above provisions," Ramesh said in his letter to chief ministers.
He also assured them that the Ministry would address the difficulties, if any, in implementing the new system.

Banks to pay for credit card frauds: RBI
MUMBAI: The Reserve Bank of India has refused to extend the deadline for upgrading security on credit card swipe machines and has ordered banks to compensate cardholders in seven days if any fraud occurs on non-compliant terminals.
If the bank fails to refund the disputed amount in seven days, it has to compensate the cardholder with a penalty of Rs 100 per day until the date of payment. At present, dispute resolution is a cumbersome process and takes several weeks in case of credit card frauds.
Banks see the new directive as indicative of the central bank's seriousness on card security. After a rise in credit card frauds, the RBI had asked banks to add security features including an electronic chip and a secret PIN which the cardholder is required to punch in the terminal to authenticate payment. This feature was to come in force from July 1. But banks were behind schedule in both issuing chip cards and in upgrading terminals to meet the new security standards.
Since the entire industry was behind schedule, the RBI was forced to extend the deadline. Banks were required to get credit card swipe machines upgraded by September-end and have all the cards upgraded by November. But a few days ahead of the September deadline, banks have again said that they are not ready.
"Various banks have approached us, seeking further extension of the time line of September 30, 2013 for complying with the task of securing the technology infrastructure," the central bank said in a statement.
Pointing out that banks were told that there would be no further extensions, the RBI said, "It has been decided not to grant any further extension of time. Accordingly, banks not complying with the requirements shall compensate loss, if any, incurred by the cardholder using card at POS terminals not adhering to the mandated standards."
There are usually two banks in every credit card transaction. One that issued the credit card and the other that has installed the swipe machine. The RBI has said that the card issuing bank should ascertain in three days whether the fraud has taken in a non-compliant machine and within seven days refund the money to the cardholder. The card issuing bank will in turn recover the money from the bank which has installed the swipe machine.

STRIKE BALLOT DEFERRED
Dear Comrades,
The National Secretariat of the Confederation congratulate the affiliates and State Committees for the strenuous efforts put in by them to propagate and campaign amongst the mass of the employees of the need for an immediate wage revision and setting up of the 7th CPC and enlist the massive participation of the Central Govt. employees for a long drawn out struggle, which commenced in 2011 and the first phase of which was culminated on 12th December, 2012 in a one day strike action. We are proud of the fact that our efforts has borne fruit as the Government had to announce the setting up of the 7th CPC on 25th. Confederation, as you are aware, had always been in the forefront in formulating demands of the CGEs, presenting and articulating the issues in spearheading struggles and negotiating the demands to reach settlement. This time also Confederation was the organization which raised the setting up of the 7th CPC and wage revision; demanded that the 7th CPC’s recommendation must be effective from 1.1.2011; insisting that the tenure of the recommendation of the 6th CPC must be ended on the expiry of the five years on par with the wage tenure of the Public Sector undertaking workers as early as in 2010. It could justify the demands with facts and figures of the unprecedented erosion of the real value of the wages of the Central Government employees due to the high rate of inflation in the economy and shooting up of the prices of all essential commodities. The campaign and propaganda unleashed by us together had its salutary impact on the thinking process of other sister organizations, compelled them to take note of the growing discontent amongst the rank and file of their membership and to realize the fact that the wage structure had become incapable of making both ends meet especially for those employees at the lower levels of the hierarchy. They had to perforce take up the issue of wage revision and setting up the 7th CPC due to the ambience created by the Confederation and its affiliates by organizing series of struggles during the period and at the same time spurning every of our attempt for a joint action. We are quite aware that sanctions cannot be generated without joint and united action of the workers. This dichotomy practiced by the predominant organizations in the JCM inflicted irreparable damage to the cause of the Central Government employees.
We are happy that the Government of India having realized that the large majority of the Central Government employees have become mentally attuned to the path of an inevitable struggle on wage revision decided to avert a confrontation by announcing the setting up of the 7th CPC. We must, however, realize that the decision of the Government tantamount to a post dated cheque which is capable of encashment only after a long period of two and half years. We must not take it lying down. The agony and sufferings of the employees, especially those at the lower levels cannot be mitigated by promises and assurances. There must be a rise in their emoluments to make them capable of meeting the ever increasing cost of essential needs. The Government must be told categorically and compelled to agree for the merger of DA with pay; and interim relief, which had all along been the case ever since the advent of the system of Pay Commission for wage revision. We must bring home the fact that there will be no question of any arrears arising from the recommendation of the 7th CPC as the Commission is mandated to make its recommendation before the crucial date of 1st January, 2016.
Even though, it is stated that the terms of reference would be finalized in consultation with all stake holders, the question of inclusion of GDS within the ambit of the Pay Commission, in all probabilities would be resisted by the Government. In the light of the passage of the PFRDA Bill in the Parliament, the Government might not agree to include the retirement benefits in the terms of reference. This apart, the Government will now refer all pending matters, be it at the National Anomaly Committee, National Council or various Departmental Councils or taken up through inter departmental references to the 7th CPC. In other words for the next two and half years none of the issues of the CGEs will be either discussed or settled. We must not allow the Government to succeed in this nefarious objective.
We must note that the present announcement of setting up of the 7th CPC has also the hidden political agenda, for many States including Delhi are to go to polls in the next few months. The National Secretariat of the Confederation will meet on 23.10.2013 at Delhi. Formal notice is being sent separately. The Sectt. will decide upon the future course of action. In view of the present announcement of the Government setting up the 7th CPC it is necessary that we should defer the strike ballot decision, which is scheduled to be held on 11th to 13th November, 2013. It is however, our considered opinion that unless we trade the path of struggle the demand for merger of DA with pay, date of effect, inclusion of GDS within the ambit of the 7th CPC and other issues in our charter of demands will not be settled at all. The campaign chalked out must, therefore, be carried out with determination and understanding that we will succeed. We request the leaders of the affiliates, State Committees and National Sectt. Members to ensure that the campaign programmes are implemented as planned.

Sub: - Inclusion of Gramin Dak Sevaks of Department of Posts under the purview of the proposed Seventh Pay Commission – regarding.
With due respect and regards, we put forth the following for your kind consideration and favourable decision please.
In the Department of Posts, the 50% of the total work force are called as Gramin Dak Sevaks and they are continuously being discriminated by separate committees formed for the consideration of their wages and service conditions.
The Supreme Court of India declared that these Gramin Dak Sevaks are holder of civil posts and it is a well settled law. Despite the judgment, the same civil servant status has not been accorded yet to them except a part in case of disciplinary proceedings.
The Fourth Central Pay Commission categorically emphasized that, the GDS issues shall be brought under the purview of Pay Commissions. But still separate committees are constituted.
The last committee constituted at the time of Sixth Central Pay Commission caused clear injustice to these employees and they are deprived all the service benefits at par with civil servants even though the law of the land declared and settled them as the holder of the civil posts.
Under these circumstances, we most humbly request the Hon’ble Prime Minister of India to consider our request and cause orders to include the GDS of the Department of Posts under the terms of reference of the Seventh Central Pay Commission.

For determining the
eligibility of the applicant for award of Scholarship for technical and
non-technical degree courses basic pay of both husband and wife, when both are
employed, will be counted for the purpose of limit of Rs.25,120/-. Hence, basic
pay of both wife / husband whenever necessary should be clearly shown against
column A-7 (i) & (ii) of the proforma application.
(3) Minimum Percentage of
Marks for Scholarship
(a) Technical
Scholarships(Mark Sheet of 10th / +2 / Degree should be
attached)
The minimum percentage
of marks required for applying Technical Scholarship is 50% irrespective of all
categories.
(b)Non-Technical
Scholarships (Mark sheet of 10th class & the +2
should be attached)
Non –Technical
scholarship is 60% for General Category Students.
The SC/ST and Low Income
Group officials basic pay up to Rs.9060/- is 50% marks.
For G.D.S. employees the
minimum percentage of marks is 45%.
Likewise OBC students
will also be eligible for availing relaxation of 10% marks for awards of
Non-technical scholarship. However, the application of Non-technical
scholarship with relaxed standards for OBC will be entertained after all other
eligible candidates have been awarded the Non-technical scholarship subject to
the condition that the additional expenditure will be met from the normal
allocation of the Circle Welfare Fund.
Physically Handicapped Scholarship
The employees including
GDS having handicapped School / College going
children may also apply in the enclosed proforma enclosing the certificate from
the Govt. Medical Authorities not below the rank of specialist concerned
(orthopaedic / surgical) in support of physical disabilities for award of
scholarship mentioned earlier at ‘F’. They should also
submit the mark sheet of the last examination. The percentage of marks
mentioned earlier will not be applicable in such case.
(4) IMPORTANT INSTRUCTIONS
TO BE FOLLOWED
Applications in prescribed format
APP-51(Specimen enclosed) should be submitted by all concerned on or before 05.11.2013 to their respective Divisions / Units i.e. last date fixed for
submission of applications complete in all respect. The applicant will please
furnish the records of the student very carefully in Column-D. Inspectors of Post and ASPs should send the
applications through their Divisions concerned (Unit head does not mean as
Sub-Division Head).
On receipt of
applications in their offices, the Divisional Heads / unit heads should
personally ensure the following before forwarding the same to the Asst.
Director (Welfare) O/o the Chief Postmaster General, Odisha Circle,
Bhubaneswar-751001 so as to reach on or before 15.11.2013 positively in single
bunch with the respective broad sheets.
a. Applications are
correctly filled in by the applicant as per check list enclosed with the
proforma and relevant documents furnished.
b. Omission / commission,
if any, when noticed may be called for from the applicants without returning
the applications and it may be ensured that applications are complete in all
respect as far as practicable.
c. A verification
certificate should be furnished by the DDOs in the application form in column
“A” in support of date of birth and basic pay.
d. Applications should be
duly recommended in own handwriting and signed by the head of the Division /
Unit Head (Unit head does not mean Sub-Division Head) with his designation
seal.
e. No application should be
withheld / rejected by the Divisional Head / Unit Head on any ground.
f. Signature and
Designation Seal of the Head of the Institution is required on the application
form (No separate certificate shall be entertained).
g. To ensure that all
applications received in their offices are forwarded to C.O. well in advance so
as to reach by the stipulated date i.e. 15.11.2013.
(5) It is observed in the
past that a large number of applications are rejected due to incomplete
information / documents as preliminary check is not carried out at Divisional
level. Hence, effort should be made to make the applications complete in all
respect to avoid summarily rejection of application. The procedure and date of
submission of application may please be rigidly adhered to. Applications
received direct at this office will be summarily rejected.
Applications received
after the due date will be summarily rejected. Applications should be
filled up carefully and required documents be attached. No correspondence of any
kind will be made for want of documents or signature etc.
Copies of application
forms may be downloaded from the email. Extra copies may be xeroxed at the
Divisional / Unit levels for supply to HOs/SOs/subordinate offices / BOs.
This may be given widest
possible publicity among the staff including Gramin Dak Sevaks immediately. The
Divisional Heads should ensure prompt despatch of copies to all other offices
