Clarifications on the proposals of handicapped proponents.

Sub: Clarifications on the proposals of handicapped proponents.

Consequent upon the deletion of Rule 17 and amendments in Rule 14 and Rule 15 of Post Office Life Insurance Rules-2011 vide Notification No. 194 published in the Gazette of India on 30.08.2012 and circulated vide this Directorate letter No. 25-112011-L1 dated 07.09.2012, references have been received from some Circles for clarification whether there is need to send the proposals submitted by Physically Handicapped persons for taking policies of PLI/ RPLI to the Consulting Actuary/ PLI Directorate and how shall the premium be calculated.
 
2. The aforesaid amendments in Post Office Life Insurance Rules-2011 have been made in compliance of orders dated 15.02.2012 of the Hon'ble Division Bench of Delhi High Court passed 'in Writ Petition (C) No. 10323/2009 whereby the Department has been directed to treat persons with disability at par with the nondisabled persons in the matter of Postal Life Insurance by providing them with the same maximum cover and charging them the same premium as being charged from non-disabled persons, regard of course being had to the risk, depending on assessment of individual cases.
 
3. In view of the above, it is clarified that accepting authority should examine all proposals of proponents individually to assess risk on the basis of report of the Medical Officer who has conducted medical examination of such proponents and take a decision of acceptance/ rejection thereof keeping in view the aforesaid  orders of the Hon'ble Division Bench, Delhi High Court. As regards referring the cases to the Consulting Actuary, it is clarified that only proposals with adverse medical condition recorded by Medical Officer be sent to the Consulting Actuary for assessment of risk and deciding upon premia.
