Dear Comrades,
In accordance with the Notification issued by the CHQ vide No. P / 1 – 1 / AIC, dated 15.10.2010 and as per Agenda No. 30 there in for Redrafting / Amendment to the Constitution of AIPEU, Group-C , Bhubaneswar Division submitted some important suggestions as follows.

THE CONSTITUTION OF AIPEU, GROUP-C
( Suggestions by AIPEU, Group-C, Bhubaneswar Division)

Article – 9
To add “Joint A , POSB Account in the name of the Secretary and Treasurer” in addition to S B Account in a scheduled Bank or Coop. Bank / Society.
Logic: We should not avoid POSB Account being primarily the employees of India Post.

Article – 12 ( i )
To add “once in three years” in place of “once in   two years” , “36 months” in place of  “24 months” and “39 months” in place of “27 months”
Logic:- The Federal Secretariat sits in every three years. Thus the members dropped in the biennial conferences of Circle / AIC continue to be the members of Federal Secretariat without giving scope to the newly elected office bearers of the Circle Union / CHQ. The conferences from Branch / Division to CHQ should be triennial instead of biennial to coincide with that of NFPE. This will also lessen the financial burdens on the Divisions and give wide scope and time  to the office bearers for better performances.

Article – 19 ( a )
To add “once in every three years” in place of “once in every two years” and “not later than 39 months” in the place of  “not later than 27 months. Accordingly the term “biennial” should be replaced with “triennial” wherever it appears in the constitution.
Logic: As above in Sl. No. – 2.

Article – 22 ( i ) (a)
Keeping the post of President, Genl. Secy., Fin. Secy. and Asst. Fin. Secy. constant, there should be three working presidents instead of two, three vice presidents instead of two, two Dy. Genl. Secretaries instead of one, six Asst. Genl. Secretaries instead of  three and seven Organizing Secretaries instead of three.
Logic: Instead of electing 15 posts excluding the Federal Councilors, the number should be raised to at least 25 as proposed above to give scope for having representations from all circles. Presently many circles falling short of quota and membership are being debarred from entering into the CHQ team. Thus, such circles are prevented from active participation in CHQ activities. For strengthening the CHQ, there should be invariably healthy representations from all circles.

Article – 24 ( i )
To add as Article 24( i ) ( f ) : To analyze and interpret the resolutions on local problems adopted in the circle conferences concluded in different circles from the last CWC and reflected in their biennial / triennial reports suggesting  suitable measures for redressal.

To add additional clauses defining the duties of the new portfolios suggested above, if accepted.

Article – 29 ( a )
As suggested for Article – 19 ( a ) in Sl. No. 3

Article – 29 ( d )
To add Article – 29 ( d ): With the involvement of  all Circle / Divisional / Branch Union’s elected office bearers, the Circle Union shall conduct circle level  Trade Union Class at least once in a tenure finalizing the detailed programme in any CWC. The expenditure is required to be shared by the Divisions and TA / DA to participants of the Divisional Union will be borne by the Divisional Union and the same for Circle Union office bearers will be borne by the Circle Union.

Article – 30 ( I ) (a)
Keeping the post of President, Vice Presidents, Circle Secretary, Asst. Circle Secy., Fin. Secy. and Asst. Fin. Secy. constant, there should be two Working Presidents, one  Deputy Circle Secretary and five  Organizing Secretaries instead of three.
Logic.- As above in Sl. No. 4.

Article – 31(iv)(i)
“The Circle Working Committee shall consist of the office bearers of the Circle Union and the Divisional Secretaries of the Circle or any other office bearers  of the Divisional Unions, if deputed by them.” – should be replaced in place of the existing version for equal treatment of  the Circle WC with Central WC as enjoined in Article – 20 ( c ).

Article – 31(iv)(iv)
To add “ and the Divisional Union shall bear the expenses of TA / DA of the members deputed to Circle WC on behalf of the Division” in addition to the existing version, provided the suggestion at Sl. No. 10 above is accepted.

Article – 31(iv)(iv)(ii)
To add Article – 31(iv)(iv)(ii)( c ) : To analyze and interpret the resolutions on local problems adopted in the Divisional / Branch conferences concluded in different branches / divisions from the last CWC and reflected in their biennial / triennial reports suggesting  suitable measures for redressal.

Article – 33
To add additional clauses defining the duties of the new portfolios suggested above at Sl. No. – 9 above, if accepted.

Article – 37 (B) (i)
To add “Apart from making direct correspondences with the Divisional Heads, the Divisional Secretaries  stationed at the Circle Head Quarters and Regional Head Quarters can make direct correspondences with the Circle Heads and Regional Heads respectively” in the place of the existing version.
Logic: This will lessen the burden on the Circle Secretaries and expedite early solution of the local problems.

Logic: The Divisions should get the lion’s share since they are conducting all the programmes in grass root levels incurring heavy expenditure frequently. Most of the programmes by the Circle Union / CHQ are also being hosted by the Divisions inviting additional financial burdens on the Divisions. When CHQ’s / Circle Union’s circulars end with the CHQ / Circle Union office bearers, Divisions have to circulate CHQ’s/Circle Union’s letters / information / programmes to all the members at grass root levels whose numbers are certainly more than that of the CHQ / Circle Union office bearers and thus the Divisions always incur more expenditure than the Circle / CHQ.

Article – 39 ( c )
After the new verification process is over, now every DDO has the up-to-date lists of membership with them. Before handing over the monthly subscriptions due towards the union to the Divisional / Branch Secretaries,  DDO should deduct the proportionate quota for Circle Union , CHQ and NFPE  including the required M O commission and remit the same to the concerned Circle Secretary, General Secretary and Secretary General . Thus, there will be no delay / complaint  in remittance of quota from the Divisional / Branch unions. Instead of applying authority on the Branch / Divisional Union, the CHQ should take appropriate step in amending the existing cause and directly giving responsibility to the DDO for collection and remittance.

Article – 40
A uniform format of Receipt Book should be in operation from Branch to CHQ with Union’s logo just by changing the Branch / Division / Circle name. CHQ should prepare a uniform format of receipt book to be printed by the branch / division / circle unions and annex in the constitution.

Article – 45 (I)(b)
The number of Vice Presidents, Assistant Secretaries, and Organizing Secretaries of the Divisional Union should be specific as has been adopted for Circle Union / CHQ. In addition there should be one  post of  Working President and one post of Dy. Divisional Secretary to accommodate more efficient members who may take over the charge of the Secretary / President in future.

Article – 53
To add Article – 53 (h)  defining the duties and responsibilities of the   new portfolios suggested above at Sl. No. - 19, if accepted.
